1) Who we are

These Terms govern your use of kiwiwheel.com (the “Service”) provided by KiwiWheel Limited (“KiwiWheel”, “we”, “us”). By accessing or using the Service, you agree to these Terms and our policies referenced in the Service.

2) Eligibility & location

• You must be at least 18 years old to use the Service.
• You must comply with applicable laws in New Zealand and in your location. If the Service is not permitted where you are, do not use it.

3) Accounts & security

• Provide accurate information and keep it up to date.
• You are responsible for all activity on your account and for keeping login details confidential.
• We may suspend accounts to protect users, the Service, or comply with law.

4) Virtual coins/credits

• Virtual coins/credits have no cash value, are not redeemable for money or items of real-world value, and are for gameplay only.
• Any purchases (if offered) buy access to virtual items; they do not increase real-world value and do not create property rights.
• We may adjust, reset, or remove virtual items to maintain the Service, address abuse, or improve gameplay.

5) Acceptable use

• No cheating, bots, scraping, reverse engineering, or interfering with security or normal operation.
• No unlawful, harmful, or abusive content or conduct; no impersonation or fraud.
• No selling, trading, or transferring accounts or virtual items outside features we explicitly provide.

6) Intellectual property

The Service, software, artwork, logos, and content are owned by or licensed to KiwiWheel and protected by intellectual property laws. We grant you a personal, revocable, non-transferable licence to use the Service for personal entertainment, subject to these Terms.

7) Disclaimers

The Service is provided “as is” and “as available”. To the extent permitted by New Zealand law, we disclaim warranties including fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted or error-free operation, or that gameplay outcomes will meet expectations.

8) Limitation of liability

To the maximum extent permitted by law, KiwiWheel will not be liable for indirect, consequential, special, or punitive losses, loss of profits, loss of data, or loss of virtual items. Where liability cannot be excluded under the Consumer Guarantees Act 1993 or other applicable law, our liability is limited to the remedies required by that law.

9) Termination

You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, abused the Service, or where required for security or legal compliance. On termination, your right to use the Service ends and virtual items may be forfeited.

10) Changes

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you (for example, via the Service). Continued use after an update means you accept the updated Terms.

11) Disputes, governing law

These Terms are governed by the laws of New Zealand. You agree to the non-exclusive jurisdiction of the courts of New Zealand. Before filing a claim, please contact us so we can try to resolve the issue.
